RESOLUTION ACCEPTING ADMISSION AND PROPOSED ORDER
– WOK “N” ROLL -
WHEREAS, the City Council adopted the Best Practices Policy, Resolution 04‑225, for liquor violations in the City of Albert Lea; and
WHEREAS, as a part of this resolution, the City Attorney is directed to prepare an Admission and Proposed Order for liquor license holders violating the City’s policy; and
WHEREAS, Wok “N” Roll has not participated in the Best Practices Policy; and
WHEREAS, Wok “N” Roll, has admitted to violating the Best Practices Policy on November 7, 2007 when an employee sold alcohol to an underage individual as part of an alcohol compliance check conducted by the Albert Lea Police Department and has agreed to payment of a civil penalty of $350.00 and a three (3) days suspension of the liquor license as per the Best Practices Policy penalties. The City Attorney is recommending that the City Council accept this agreement; now, therefore
THE CITY OF ALBERT LEA RESOLVES:
Sec. 1. That the City Council hereby acknowledges the admission and orders the payment of the civil penalty as outlined in the order.
Sec. 2. That reading of this resolution is waived by Council consent.
Sec. 3. That publication of this resolution shall be dispensed with under provisions of Section 3.08 of the Charter of the City of Albert Lea.
That the motion for the adoption of the foregoing resolution was duly seconded by Councilor Brooks, and upon a vote being taken thereon, the following voted in favor thereof: Councilors Rasmussen, Baker, Marin, Olson, Severtson, Brooks and Mayor Erdman.
And the following voted against the same: None.
