A RESOLUTION ORDERING IMPROVEMENT –
2008 MILL, OVERLAY AND CURB REPLACEMENT PROJECT
(JOB 0801)

            WHEREAS, Resolution 08-37 of the City Council adopted the 11th day of February, 2008, fixed a date for a public hearing for the 2008 Mill, Overlay and Curb Replacement Project (Job 0801) for the bituminous overlay and scattered curb & gutter replacement of residential streets in the north west part of the city; and

WHEREAS, ten days’ mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 10th day of March, 2008, at which all persons desiring to be heard were given an opportunity to be heard thereon, now, therefore

THE CITY OF ALBERT LEA RESOLVES:

            Sec. 1.       That such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report.

            Sec. 2.       That such improvement is hereby ordered as proposed in the council Resolution 08-37 adopted 11h day of February, 2008.

            Sec. 3.       That the City Engineer is hereby designated as the engineer for this improvement.  The engineer shall prepare plans and specifications for the making of such improvement.

            Sec. 4.       That the City Council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bonds

            Sec. 5.       That reading of this resolution is waived by Council consent.

            Sec. 6.       That publication of this resolution shall be dispensed with under provisions of Section 3.08 of the Charter of the City of Albert Lea.

The motion for the adoption of the foregoing resolution was duly seconded by Councilor Baker and upon a vote being taken thereon, the following voted in favor thereof:  Councilors Rasmussen, Baker, Marin, Olson, Severtson, Brooks and Mayor Erdman.

And the following voted against the same:  None.
