A RESOLUTION GRANTING A VARIANCE TO 121 LAKE CHAPEAU DRIVE

 

            WHEREAS, the Board of Appeals, at its regular meeting of March 18, 2008, considered the request of Jerry and Janet Hickman for property they own at 121 Lake Chapeau Drive, for a variance to enlarge an existing detached accessory structure that exceeds the City of Albert Lea ordinance which allows 900 square feet of detached accessory structures; and

            WHEREAS, this lot does not conform to the current zoning standards of an R-1 District as it was grandfathered in when this property was annexed into the City of Albert Lea; and

            WHEREAS, the Board of Appeals has recommended that the City Council grant the variance having determined that this request meets the criteria for approval; now, therefore

THE CITY OF ALBERT LEA RESOLVES:

            Sec. 1.       That a variance to enlarge an existing detached accessory structure that exceeds the City of Albert Lea ordinance, which allows 900 sq. ft. of detached accessory structures and not one of these structures can be bigger than 24’ X 36’ legally described as:

Beginning at a point on the east line of Section 12-T102N-R22W, which point is 2088.15 feet north of the southeast corner of said section; then north 350 feet on said east line of said section; thence west 720 feet on a line parallel with the centerline of CSAH No. 46 (formerly USH No. 16); thence south 350 feet on a line parallel with the east line of said section; thence east 720 feet to the point of beginning; being part of the NE1/4, SE1/4, Section
12-T102N-R22W; subject to highway right-of-way easement on the east 50 feet thereof, and subject to other easements, if any

            Sec. 2.       That approval of this variance is based on the recommendation of the Board of Appeals and on the records of the Board’s public hearing on the application, which record is incorporated herein by reference.

            Sec. 3.       That reading of this resolution is waived by Council consent.

            Sec. 4.       That publication of this resolution shall be dispensed with under provisions of Section 3.08 of the Charter of the City of Albert Lea.


That the motion for the adoption of the foregoing resolution was duly seconded by Councilor Olson, and upon a vote being taken thereon, the following voted in favor thereof: Councilors Rasmussen, Baker, Olson, Severtson, Brooks and Mayor Erdman.  Absent:  Councilor Marin.

And the following voted against the same:  None.
