A RESOLUTION APPROVING AN ADMINISTRATIVE
SURVEY OF LOTS OF RECORD
- MOTOR INN -

            WHEREAS, Chapter 54, Section 54-9 of the City Code (Subdivision Ordinance) allows for division and consolidation of lots of record, and

            WHEREAS, a legal description and survey was prepared by Jones, Haugh & Smith, Inc. for Motor Inn Co., and

            WHEREAS, this administrative survey of lots of record within the B-2 Community Business District is consistent with the requirements of the Zoning Ordinance for lots within the B-2 Community Business  District; now, therefore

THE CITY OF ALBERT LEA RESOLVES;

            Sec. 1.       That the Administrative Survey including Lots 13 & 14, Block 1, Buschbom Addition and Lots 5, 6, 7, Block 4, Buschbom Third Addition, Albert Lea, Freeborn County, Minnesota, is approved in accordance with the following descriptions:

Tract D

Lot 13, Block 1, Buschbom Addition, as the same is platted and recorded in the office of the County Recorder of Freeborn County, Minnesota; less the Southwesterly 55.36 feet; said 55.36 feet being measured perpendicular to the southwesterly line of said Lot 13; and the Southwesterly 50.00 feet of Lot 14, Block 1 in said Buschbom Addition; said 50.00 feet being measured perpendicular to the southwesterly line of said Lot 14;

together with the Northwesterly 100.00 feet of Lot 6, Block 4, Buschbom Third Addition, as the same is platted and recorded in the office of the County Recorder of Freeborn County, Minnesota;  said 100.00 feet being measured perpendicular to the northerly line of said Lot 6;

and together with the Northwesterly 100.00 feet of the Westerly 50.00 feet of Lot 7 in said Block 4;  said 100.00 feet being measured perpendicular to the northerly line of said Lot 7, and said 50.00 feet being measured perpendicular to the westerly line of said Lot 7;

and together with the Easterly 22.76 feet of the Northwesterly 100.00 feet of Lot 5, Block 4 in said Buschbom Third Addition;  said 22.76 feet being measured perpendicular to the easterly line of said Lot 5, and said 100.00 feet being measured perpendicular to the northerly line of said Lot 5;

also together with that part of the vacated alley in said Buschbom Addition, which lies between a northwesterly extension of the westerly line of the Easterly 22.76 feet of Lot 5, Block 4 in said Buschbom Third Addition and a northwesterly extension of the easterly line of the Westerly 50.00 feet of Lot 7, Block 4 in said Buschbom Third Addition; said vacated alley being described in Document No. 407232 in the office of the Freeborn County Recorder.

Tract E

The Northwesterly 60.00 feet of Lot 13, Block 4, Buschbom Third Addition, as the same is platted and recorded in the office of the County Recorder of Freeborn County, Minnesota;  said 60.00 feet being measured perpendicular to the northerly line of said Lot 13;

together with the Southeasterly 60.00 feet of the Northwesterly 160.00 feet of Lot 9, Block 4 in said Buschbom Third Addition; said 60.00 feet and 160.00 feet being measured perpendicular to the northerly line of said Lot 9;

and together with the Southeasterly 100.00 feet of the Northwesterly 200.00 feet of Lots 6, 7 & 8, Block 4 in said Buschbom Third Addition; said 100.00 feet and 200.00 feet being measured perpendicular to the northerly line of said Lots 6, 7 & 8.

            Sec. 2.       That reading of this resolution is waived by council consent.

            Sec. 3.       That publication of this resolution shall be dispensed with under provisions of Section 3.08 of the Charter of the City of Albert Lea.

That the motion for the adoption of the foregoing resolution was duly seconded by Councilor Brooks, and upon a vote being taken thereon, the following voted in favor thereof: Councilors Rasmussen, Baker, Olson, Severtson, Brooks and Mayor Erdman.  Absent:  Councilor Marin.

And the following voted against the same:  None.
