A RESOLUTION TO POSTPONE THE ORDERING IMPROVEMENT AND PREPARATION OF PLANS – 2008 STATE AID STREETS - MILL, OVERLAY, CURB REPLACEMENT AND SIDEWALK REPLACEMENT PROJECT

WHEREAS, Resolution 08-70 of the City Council adopted the 24th day of March, 2008, fixed a date for a public hearing for the 2008 State Aid Streets Mill, Overlay, Curb Replacement and Sidewalk Replacement Project (Job 0802) for the bituminous overlay, miscellaneous curb & gutter replacement and miscellaneous sidewalk replacement on various State Aid Streets as listed:
Hawthorne Street - Lakewood Avenue to Garfield Avenue
Lakewood Avenue – Richway Drive to North Shore Avenue
Lakeview Blvd. – Fountain Street to Vine Avenue
Third Street – Madison Avenue to Newton Avenue
WHEREAS, ten days’ mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 14th day of April, 2008, at which all persons desiring to be heard were given an opportunity to be heard thereon, and
WHEREAS, in order to meet State Aid Standards and use State Aid Funds, no parking would be allowed on the following streets:
Lakewood Avenue from Hawthorne Street to Richway Dr. – No Parking on the west side.
Lakeview Blvd from Fountain Street to Grace Street – No Parking on the west side.
Third Street from Madison Avenue to Newton Avenue – No Parking on the south side.
NOW, THEREFORE, BE IT RESOLVED THE BY COUNCIL OF THE CITY OF ALBERT LEA, MINNESOTA:
Sec. 1. That the ordering of this improvement be postponed until April 28, 2008 and be reconsidered by the City Council of the City of Albert Lea at their next council meeting ( 4-28-08).
Sec. 2. That reading of this resolution is waived by Council consent.
Sec. 3. That publication of this resolution shall be dispensed with under provisions of Section 3.08 of the Charter of the City of Albert Lea.
That the motion for the adoption of the foregoing resolution was duly seconded by Councilor Severtson and upon a vote being taken thereon, the following voted in favor thereof: Councilors Rasmussen, Baker, Marin, Olson, Severtson, Brooks and Mayor Erdman.
And the following voted against the same: None.
